1. Introduction
The general terms and conditions of the online store mariposacoffee.si are compiled in accordance with According to the Consumer Protection Act (ZVPot), the Personal Data Protection Act (ZVOP-1) and the Electronic Communications Act (ZEKom-1).
The online store mariposacoffee.si (hereinafter also referred to as the "store") is operated by the company Mariposa, coffee roasting, Klemen Maček sp, Miklošičeva ulica 4c, 1230 Domžale, registration number: 7153244000, tax number: SI34341579, which is also a provider of e-commerce services (hereinafter also referred to as the seller or Mariposa).
The General Terms and Conditions determine the operation of the online store mariposacoffee.si, the rights and obligations of the user and the store, and regulate the business relationship between Mariposa and the buyer. The General Terms and Conditions also regulate individual purchase rules at the pickup points of the company Klemen Maček sp.
Availability of information
The company undertakes to always provide the customer with the following information:
- company identity (company name and registered office, register number)
- contact information that enables the user to communicate quickly and efficiently (e-mail, address)
- essential characteristics of goods or services
- product availability (every product or service offered on the website should be available within a reasonable time)
- conditions of product delivery or service performance (method, place and deadline of delivery)
- all prices must be clearly and unequivocally determined and must clearly show whether they already include taxes and delivery costs)
- method of payment and delivery
- time validity of the offer
- the period during which it is still possible to withdraw from the contract and the conditions for withdrawal; in addition, also about if and how much it costs the customer to return the product,
- explanation of the complaint procedure, including all information about the contact person or customer service department.
2. General
The customer is bound by the general conditions valid at the time of purchase (submission of the online order). When placing an order, the user is specifically warned about general business conditions and by placing an order confirms his familiarity with them. The general terms and conditions of business can also be viewed at the collection points of Klemen Maček sp.
All content published on www.mariposacoffee.si is the property of Mariposa and may only be used for non-commercial purposes. It may not be copied, reproduced or distributed in any other way without the permission of Mariposa.
Mariposa reserves the right to change the content published on the website www.mariposacoffee.si.
3. Ordering goods and services
In the online store www.mariposacoffee.si, you can order goods and services in the following way: Via the order form in the online store.
When ordering via the form on the website, it is mandatory to provide a phone number and email address, where we will be able to inform you about the progress of the order free of charge (all received SMS are free for you). Regarding the deviation from the order, see point 8.
The purchase agreement (i.e. the first email about the order status) is stored in electronic form on the Mariposa server. The purchase agreement is accessible to the buyer upon request.
4. Prices and promotional offers
It is not possible to redeem gift vouchers, bonuses, promotional codes, etc. when making a purchase at the pick-up point.
All prices listed on the website are expressed in euros and include VAT, unless explicitly stated otherwise.
The prices are valid at the moment of placing the order and have no further validity.
The prices are valid in the case of payment with the above-mentioned payment methods, under the above-mentioned conditions.
Despite our best efforts to provide the most up-to-date and accurate information, it may happen that the price information is incorrect. In this case, or if the price of the item changes during the processing of the order, Mariposa will allow the customer to cancel the purchase.
Discounts, promotional codes, etc. they do not add up.
Deposited funds from gift vouchers, bonuses and advance invoices do not bear interest. Gift vouchers and discount bonus codes cannot be exchanged for cash.
5. Methods of payment
You can pay for ordered goods and services in the following ways:
- by transfer to Mariposa account according to offer/proforma invoice**
- by payment or credit card (MasterCard®, Visa, Visa Electron, BA Maestro)*
- In installments through Grenkeleasing doo (valid for amounts over €500). To make a purchase in installments, please write to us at info@mariposacoffee.si so that we can provide you with the documentation.
*For individual orders, we reserve the right to request payment by bank transfer to the Mariposa account according to the offer/pro forma invoice, with the Price still applicable.
**After receipt of payment according to the offer/proforma invoice, the order will proceed to the processing process.
When paying with a credit card online, in the event of an order cancellation or change in payment method on the part of the user, please notify us at info@mariposacoffee.si for crediting the card or refunding.
Payment and credit cards
In case of payment by payment or credit cards, the following conditions also apply:
- the payer (data in the user's account) must be the same person or organization as the owner of the payment or credit card,
- After confirmation of receipt of the order, it is not possible to change the content of the order or the final amount of the order, except in exceptional cases with the approval of Mariposa.
Promotional codes
The promotional code brings various advantages when purchasing and is limited in time. You can find the active promotional code on the front page of the advertising message, on the page of each department, in our e-newsletter or other media.
In the event that the buyer uses the promotional code, but later cancels the order with the used code of his own free will, or the shipment is damaged during transport, he is no longer entitled to a new benefit from this code.
Using the promo code:
- Select the items you want to buy and add them to your cart. When you're done adding items to your cart, click the Continue button To the cashier. Choose a delivery method, specify a delivery address and choose a payment method.
- In the same step, it is written at the top: Do you have a coupon? Click here to enter the code, and enter the promotional code in the Coupon code field and confirm the entry by clicking the button Redeem the coupon.
- Only one promotional code can be used in each purchase (for example: when ordering 2 items, you can use a maximum of 1 promotional code at the same time).
- The value of your order must be at least €1 higher than the value of the promotional discount code.
- If you want to use a discount code in addition to a promotional code, the number of codes must not exceed the number of different items ordered. Enter different codes at the same time in the Coupon code field, separating them with a comma or space. Then click the button Redeem the coupon.
- When you enter a promotional code, the value of the promotional code is automatically deducted from the price of your order - Order Summary. There remains an amount that still needs to be settled.
- The combination of different types of benefits (discount code, promotional code and bonus) within the same order is not possible.
6. Issuance of an invoice
After delivery of the ordered items, Mariposa sends the buyer an e-invoice to the buyer's e-mail address. In the case of personal collection at the collection point, the buyer receives a printed invoice for the purchased items upon collection. The buyer receives an invoice for each separate order or separate shipment within an order separately.
The invoice contains a breakdown of the price and all costs related to the purchase, as well as a notice of the right to withdraw from the contract.
The buyer is obliged to check the correctness of the data before placing the order. We do not take into account objections made later regarding the correctness of the issued invoices.
7. Purchase procedure
To make a purchase on all Mariposa websites, enter your information in the order form and click the order button.
- Product selection: In the order form, you select the appropriate product or the quantity you want to order. Before clicking on the order button, information about the product you are ordering is always available on the website.
- You continue by clicking continue to the checkout, where you enter your information and decide on the payment method.
- Order confirmation: When you place an order, you will be redirected to a website with a message that your order has been accepted. In addition, you will receive an order confirmation with all information regarding the type of product, quantity, final price and delivery date to the entered e-mail address.
- Order cancellation: The order is considered confirmed if the buyer does not cancel the order. Upon receiving the order confirmation, Mariposa checks the stock status or the possibility of delivery. If the item cannot be delivered within the specified time, the buyer will be notified at the registered phone number or e-mail address. The buyer can cancel the order by replying to info@mariposacoffee.si, which he received when ordering, or by calling the phone number 041 299 275.
- Shipping: Mariposa prepares and ships the goods using the agreed shipping method within the agreed time frame.
Products that are in stock will be shipped no later than three business days from the date of payment. If the order is placed on a working day before 12 noon, the shipment will be dispatched the next working day.
For products that are not in stock, the delivery time is up to 30 working days from the date of payment. If you still do not receive the products during this time, you are entitled to a refund of the amount paid from the withdrawal from the sales contract without additional costs.
For articles from the category "PROFESSIONAL COFFEE PREPARATION APPLIANCES AND COFFEE GRINDERS" delivery is 8 to 10 weeks from the date of payment.

8. Purchase for legal entities
Purchase process for legal entities is exactly the same as for natural persons, except that the "Company name" is filled in when ordering and you confirm your agreement with the terms of business.
If you want a business account, you accept the terms of business that apply to businesses. The main difference is in the possibility of withdrawing from the contract: we allow companies, independent entrepreneurs and other legal entities to return the delivered items within the warranty conditions. Listed legal entities they do not have the option of withdrawing from the contract within 14 days of receiving the item without reason, as is the case for consumers (natural persons).
Refunds are not possible for legal entities. Mariposa General Terms and Conditions also apply to purchases by legal entities. For more information on refund options under the warranty conditions, please contact us at info@mariposacoffee.si.
The Mariposa online store offers the following payment methods to legal entities:
- by transfer to the account according to the offer/proforma invoice
- by payment or credit card (MasterCard®, Visa, Visa Electron, BA Maestro)
- purchase in installments through Grenkeleasing doo, Verovškova ulica 64a, 1000 Ljubljana.
- deferred payment (applies to public and local administration organizations and companies that achieve the appropriate credit rating).
Delivery is free for online orders of small packages over €199.99 and large packages over €499.99.
For us, packages are delivered by Pošta Slovenije, DPD and DHL, which deliver most packages the next business day (if the item is in stock in our central warehouse) after notification of shipment.
For all orders of items from the category "PROFESSIONAL COFFEE PREPARATION APPLIANCES AND COFFEE GRINDERS", postage is charged separately before the ordered items are shipped.
9. Retention of title
We reserve title to the goods and services sold and they remain the property of Mariposa even after they have been delivered to you until you have paid for them in full.
10. Withdrawal from the contract and return of goods
You can cancel the order for goods and services at any time, before confirming the order.
The consumer has the right to notify the company (e-mail address: info@mariposacoffee.si) within 14 days of receipt of the goods that he/she withdraws from the contract, without having to state the reason for his/her decision. The deadline begins one day after the date of receipt. The only cost borne by the consumer in connection with the withdrawal from the contract is the cost of returning the goods (which in the case of shipping is charged according to the price list of the delivery service and depends on whether it is a shipment/package). The goods must be returned to the seller no later than 14 days from the date of the notification of withdrawal from the contract (purchase). Contract withdrawal form.
The consumer must return the item to the seller undamaged and in the same quantity, unless the item is destroyed, damaged, lost or its quantity has decreased through no fault of the consumer. The consumer may not use the articles unhindered until the withdrawal from the contract. The consumer may inspect and test the items to the extent necessary to determine the actual condition. The consumer is responsible for a decrease in the value of the goods if the decrease is the result of conduct that is not absolutely necessary to determine the nature, properties and functioning of the goods.
In case of withdrawal from the contract where a bonus, discount code or promotional code was used, these funds are considered as a discount and are not returned to the user. Only the paid amount will be returned to the user's TRR or other means of payment, insofar as the user expressly requests this. When withdrawing from the contract, the gift voucher is considered as a means of payment and the amount is also returned to the user.
The consumer does not have the right to withdraw from the contract for contracts, the subject of which is an article that was manufactured according to the consumer's precise instructions, that was adapted to his personal needs, that due to its nature is not suitable for return, that is perishable or that has already expired best before.
Withdrawal from the contract is not possible for goods:
- for goods or services, the price of which depends on fluctuations in the markets, over which the company has no influence and which may occur within the withdrawal period from the contract;
- for goods that are manufactured according to the exact instructions of the consumer and adapted to his personal needs;
- for goods which, due to their nature, are not suitable for return, are perishable or expire quickly;
- for the service provided, if the company fulfills the contract in full and the provision of the service began on the basis of the consumer's express prior consent and with the consent to lose the right to withdraw from the contract when the company fully fulfills it;
- sealed goods that are not suitable for return due to health protection or hygiene reasons, if the consumer has opened the seal after delivery;
- digital content that is not delivered on a tangible data carrier, if the provision of the service began based on the consumer's express prior consent and consent.
The refund of payments made, including delivery costs (except for additional costs due to the choice of a type of delivery that is not the most affordable standard form of delivery offered by the company) will be made as soon as possible, but no later than within 14 days of receiving the notice of withdrawal from the contract . The company returns the received payments to the consumer using the same means of payment that the consumer used (which is most commonly by payment to a transaction account).
The return of the received goods to the company within the withdrawal period is considered a notice of withdrawal from the contract.
The right to withdraw from the contract is more precisely regulated by the provisions Act on Consumer Protection (in detail Article 43.č and Article 43.d).
The returned goods must be accompanied by a copy of the invoice and your personal data together with the number of the personal bank account to which we return the money.
If the goods/services do not work properly or do not work according to your expectations, please contact us via the contact form or send a message to info@mariposacoffee.si. This will help you avoid possible misuse of the goods/services and damage to the goods themselves and other things.
The possibility of withdrawing from the contract is intended so that you can open the product, inspect it and, if it does not suit you, or your expectations were different, withdraw from the purchase. These recommendations do not apply if the product is defective or does not work at the time of purchase. In this case, it is about asserting a material defect or warranty.

11. Warranty and claim of material defect
Warranty
Items have a warranty if it is stated so on the warranty card or invoice. The guarantee is valid if the instructions on the guarantee sheet are followed and upon presentation of the invoice. The warranty periods are indicated on the warranty sheets or on the invoice. There is a form for returning an item under warranty here.
If warranty information is not available on the website, the item does not have a warranty or the information is currently unknown. In the latter case, the buyer can contact Mariposa, who will provide up-to-date information.
The fastest way to file a complaint is directly with an authorized repairer. The authorized repairer is obliged to carry out the warranty repair within 45 days of receiving the goods.
If the defects are not rectified within a total period of 45 days from the day the manufacturer, seller or authorized service received a request from the consumer to correct the defects, the manufacturer must replace the goods with identical, new and faultless goods free of charge to the consumer.
A factual error
As a consumer, you have the right to exercise your rights from a material error in compliance with the provisions of the Consumer Protection Act (Official Gazette of the Republic of Slovenia, 98/04 - official consolidated text, with amendments, additions and corrections).
The defect in the product is material:
- if the thing does not have the properties necessary for its normal use or for traffic;
- if the item does not have the properties required for the specific use for which the buyer is buying it, but which the seller was aware of or should have been aware of;
- if the thing does not have the characteristics and features that have been explicitly or tacitly agreed or prescribed;
- if the seller has delivered a thing which does not correspond to the sample or model, unless the sample or model has been shown only for notice.
The consumer can assert his rights from a material defect if he informs the seller about the defect within two months from the day the defect was discovered.
The seller is not responsible for material defects in the goods that become apparent after two years have passed since the item was delivered.
The buyer can request at his own choice:
- Error correction
- Refund of the amount paid in proportion to the error
- Exchange of goods
- Refund of paid amount
If you believe that the purchased product has a real defect, contact us as soon as possible on the telephone number 041 299 275 or info@mariposacoffee.si and attach your invoice or order number. As soon as possible, we will offer you a replacement or a refund.
When exercising the rights under this title, the consumer must describe the defect in more detail in the defect notification and allow the seller to inspect the product.
If the error is not disputed, the company must comply with the consumer's claim as soon as possible, but no later than within 8 days. However, if there is a dispute about the error, the company must give the consumer a written answer within 8 days.
The right to assert a factual error is more precisely regulated by the provisions Consumer Protection Act (details from Article 37 onwards).
12. Order Changes
To make changes to your order or cancel your order, you can call us at 041 299 275 or write to us at info@mariposacoffee.si.
Change of items from the order
- If you have ordered several items in one order, cancel only the unwanted item. Then order the desired product model again - by submitting a new online order. The remainder of the original order remains valid. The solution is only suitable when it comes to personal collection of the items, otherwise you would have to pay the delivery costs twice.
- Another option you have is to cancel the order in its entirety and re-order all items.
Change of payment method
A change in the payment method after the order has been submitted is possible in cases where the online card payment method or pre-invoice was chosen (and in none of these cases has payment been made yet). In this case, you can request to change the payment method to cash. In other cases, it is necessary to cancel the order and submit a new one.
Change of date and method of delivery
Unfortunately, you cannot change the delivery method when placing an order. This means that it is necessary to cancel the order and submit a new one.
If the agreed delivery date does not suit you (we inform customers about the delivery date via SMS or email), you can write to us at info@mariposacoffee.si and arrange a different delivery date.
13. Delivery and supply of items
Our contractual partners for delivery of shipments in Slovenia are Pošta Slovenije and DPD, but Mariposa reserves the right to choose another delivery service if it can fulfill the order more efficiently.
If we don't have all the items in stock for the placed order, you can choose partial delivery. In the case of partial delivery, we will divide your order into several shipments. We will ship items that are in stock immediately, and others as they become available. If you decide on a partial delivery, we will charge you the delivery cost for each shipment separately.
You can collect the shipment in person or have an authorized representative, legal representative or guardian collect it on your behalf.
If you are not at the address provided upon delivery, Pošta Slovenije will send you a message with instructions on where to pick up the package or who to contact to have the package re-delivered to you. You can also arrange a new delivery date by phone with the DPD delivery person.
You will receive the invoice for your order within 24 hours to the e-mail address with which you submitted the online order.
Mariposa reserves the right to split the order into multiple shipments due to different delivery times for the items in the order. In this case, the ordered items will be delivered to you individually in multiple shipments.
Delivery cost
- The cost of postage for delivery within Slovenia is 6,62 €.
- For purchases over 50 EUR Shipping is free in Slovenia.
You will be informed about the delivery price in detail during the online order submission process.
Since the delivery service delivers items within the working hours of Pošta Slovenije (and the postman's working hours of a certain area), you can also decide to deliver to any other name or address. For example in a jobThe same applies to the DPD delivery service. If delivery to a business address is selected, the delivery person will hand over the package to an authorized person at the company to receive the shipment.
If you are not at the intended place (company, office, hospital, student dormitory, etc.) at the time of delivery, the delivery person will leave a message with instructions for further action. A visit to the nearest post office is usually sufficient, but you can call them to have the parcel delivered again for free.
Delivery dates
About possible longer delivery times or undeliverable items, we will keep you informed via e-mail. If a longer delivery time does not suit you, we can let me know and we will remove the item from the order or replace it with another one.
If you were not at the delivery address and you received a notification that the shipment is waiting for you at the post office, you can contact the address post office, which will re-deliver the shipment to you free of charge.
For items we have in stock, delivery is usually within 3 working days, but no later than within 5 working days.
For items that we do not have in stock, we do not have information on how quickly we can deliver them, but we usually deliver them within 14 days.
13.1. SPECIAL CONDITIONS FOR COFFEE DELIVERY
Because we want to ensure the highest quality and quality, all coffee is roasted to order. This means that we collect orders by every Friday and then roast the coffee the following week.
To ensure that the roasted coffee reaches you as fresh as possible, we ship it no later than the second day after roasting. This is our promise and commitment to quality.
14. Liability
Mariposa is not responsible for any complications or problems that may arise from the improper use of goods/services. Likewise, the employees of the Mariposa online store's customer service center are not responsible for personally resolving any problems regarding the use of goods/services.
The Mariposa company is not responsible for any occasional problems with the operation of the website www.mariposacoffee.si, any inaccuracy of information, or for any damage caused by the use of inaccurate or incomplete information.
Mariposa reserves the right to withdraw from the contract or to execute the order if a material error occurs in the offer. A material error includes elements on the basis of which Mariposa would not agree to conclude the contract. The aforementioned errors also include obvious errors in the price, which may be the result of technical and other problems.
Communication takes place exclusively via the website and e-mail.
14. Protection of personal data
Mariposa is committed to the permanent protection of all user personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 and ZVOP-1.
All detailed information on the processing of personal data can be found on the page Protection of personal dataThe user must be aware that he is obliged to provide Mariposa with his personal data in a correct and truthful form, and is also obliged to inform Mariposa of any changes to his data. By accepting these terms and conditions, the user confirms that the personal data he has provided is correct.
15. Complaints and Disputes
Mariposa complies with applicable consumer protection legislation. Mariposa strives to fulfill its duty to establish an effective complaints handling system and to designate a person with whom the customer can contact by phone or e-mail in case of problems. Complaints can be submitted in writing by e-mail to the following address: info@mariposacoffee.si. The company will confirm receipt of the complaint within three working days, inform the customer of how long it will take to process it and keep them informed of the progress of the procedure.
Mariposa makes every effort to resolve any disputes amicably. If any disputes are not resolved amicably, the court in Domžale shall have jurisdiction over them.
Out-of-court settlement of consumer disputes
In accordance with legal norms, we do not recognize any provider of out-of-court consumer dispute resolution as competent for resolving a consumer dispute that a consumer could initiate in accordance with the Out-of-Court Consumer Dispute Resolution Act. The company Mariposa, which as a provider of goods and services enables online shopping in Slovenia, publishes an electronic link to the online consumer dispute resolution platform (SRPS) on its website. The platform is available to consumers at the link HERE.
The aforementioned regulation comes from the Act on the Out-of-Court Settlement of Consumer Disputes, Regulation (EU) No. 524/2013 of the European Parliament and of the Council on the online resolution of consumer disputes and the amendment of Regulation (EC) no. 2016/2004 and Directive 2009/22/EC.
